Taileva ("Taileva," "we," "us," or "our") is committed to managing personal data in accordance with applicable privacy laws. This Privacy Policy ("Policy") describes how we may collect, use, disclose, process, store, and transfer personal data when you access or use our website located at www.taileva.com ("Website"), mobile applications ("Apps"), and related services (collectively, "Services").

By accessing or using the Services, creating an account, making a purchase, or providing us with any information, you expressly consent to this Privacy Policy and our data practices as described herein. This consent includes consent to the collection, use, disclosure, and transfer of your personal data, including across international borders, as set forth in this Policy.

This Policy applies to all users of the Services, regardless of location, and supplements any other privacy notices or terms that may apply to specific Services or jurisdictions.

We reserve the right to modify, amend, or update this Policy at any time, in our sole discretion, for any reason or no reason. Changes will be effective immediately upon posting to the Website unless otherwise specified. We may, but are not required to, notify you of material changes via email or through a notice on the Services.

Your continued use of the Services after any changes constitutes your acceptance of the updated Policy and consent to the modified data practices. It is your responsibility to review this Policy periodically.

The current version of this Policy is always available at www.taileva.com/privacy. The "Effective Date" at the top indicates when this Policy was last updated.

1.2 Children's Privacy

The Services are not directed to individuals under the age of 18 (or the age of majority in your jurisdiction). We do not knowingly collect personal data from children. If we learn we have collected personal data from a child without appropriate parental consent, we will delete it. "Personal Data" means any information that identifies, relates to, describes, references, is reasonably capable of being associated with, or could reasonably be linked, directly or indirectly, to you, your household, or your device. This includes, but is not limited to, identifiers, commercial information, internet activity, geolocation data, inferences, and any other information defined as personal data, personal information, or similar terms under applicable laws.

Personal Data does not include publicly available information lawfully obtained from government records, deidentified data that cannot reasonably be linked back to you, or aggregated data.

"Process" or "Processing" means any operation performed on Personal Data, including collection, recording, organization, structuring, storage, adaptation, retrieval, consultation, use, disclosure, transmission, dissemination, restriction, erasure, or destruction.

  • Payment Information: Credit card numbers, debit card numbers, banking information, billing address, and transaction details (note: complete payment card data is processed by our payment processors; we receive tokenized versions)

  • Transaction Information: Purchase history, subscription details, products viewed or added to cart, wish lists, order history, returns and exchanges, customer service interactions

  • Communications: Information you provide when contacting us, including customer service inquiries, reviews, testimonials, comments, feedback, survey responses, contest or sweepstakes entries, social media interactions, and adverse event reports

  • User Content: Photos, videos, reviews, testimonials, comments, posts, and other content you submit or upload to the Services

  • Demographic Information: Age range, income range, household size, occupation, interests, lifestyle information, and other demographic data (including sensitive demographic data when you voluntarily provide it in surveys)

  • Any Other Information: Any other information you choose to provide to us through any means

When you access or use the Services, we may automatically collect Personal Data about you and your devices, including:

  • Device Information: IP address, MAC address, device identifiers (UDID, IDFA, Android ID), device type, operating system, browser type and version, browser language, screen resolution, device settings, mobile network information, and unique device tokens

  • Usage Information: Pages visited, links clicked, time spent on pages, search queries, browsing history, access times and dates, referral URLs, navigation paths, clickstream data, scrolling behavior, mouse movements, keystroke patterns, and interaction with advertisements and content

  • Analytics and Heatmap Tools: Hotjar, FullStory, Crazy Egg, or similar tools

  • Advertising Networks and Exchanges: Various ad networks and programmatic advertising partners

These third parties may use tracking technologies for their own purposes, including building profiles and serving ads on other websites and services. We do not control third-party tracking technologies. Review their privacy policies for information about their data practices.

  • IT and Security Services: Infrastructure, cybersecurity, and technical support providers

  • Professional Services: Legal, accounting, auditing, consulting, and advisory services

  • Any Other Service Providers: Third parties that provide services to support our business operations

6.2 Advertising and Marketing Partners

We may share Personal Data with advertising partners, marketing platforms, and analytics providers for targeted advertising and marketing purposes, including:

  • Social Media Platforms: Meta (Facebook/Instagram), TikTok, Snapchat, Pinterest, Twitter, LinkedIn

  • Search and Display Advertising: Google Ads, Microsoft Advertising, Amazon Advertising

  • Attribution and Analytics: AppsFlyer, Adjust, Branch, and attribution platforms

Under certain privacy laws, sharing Personal Data with advertising partners may constitute a "sale" or "sharing" for cross-context behavioral advertising. You have the right to opt out of such sales or sharing (see Section 10).

We may share Personal Data with our parent company, subsidiaries, affiliates, and other entities under common ownership or control for any business purpose, including analytics, marketing, product development, and consolidated business operations.

When you purchase our products through third-party marketplaces (Amazon, Chewy, Walmart, etc.), we may receive Personal Data from those platforms to fulfill your order. We may also share Personal Data with these platforms for analytics and advertising purposes.

We may disclose Personal Data to government authorities, regulatory agencies, law enforcement, courts, and other public authorities when:

We may share Personal Data with third parties when you direct us to do so or provide your consent, including when you use social login features or authorize integrations with third-party services.

6.10 Aggregated and Deidentified Data

We may share aggregated, deidentified, or anonymized data that cannot reasonably be used to identify you with third parties for any business purpose, including research, analytics, marketing, and public reporting. This information is not considered Personal Data.

6.11 No Restrictions on Sharing

Except as limited by applicable law, we reserve the right to share Personal Data with any third party for any lawful business purpose. We may share Personal Data in ways not specifically described in this Policy, provided we have a lawful basis for doing so.

 

7. International Data Transfers

Your Personal Data may be transferred to, stored, and processed in countries other than your country of residence, including the United States, where data protection laws may be different from those in your country.

By using the Services, you consent to the transfer of your Personal Data to:

  • The United States and other countries where we or our service providers operate

  • Any country where our servers, cloud storage, or data centers are located

  • Any country where our service providers, partners, or affiliates are located

Personal Data transferred outside your country of residence may be subject to access by law enforcement, government agencies, courts, or regulatory authorities in the destination country in accordance with local laws.

7.1 Safeguards for International Transfers

WE ARE NOT LIABLE FOR ANY UNAUTHORIZED ACCESS, USE, OR DISCLOSURE OF PERSONAL DATA RESULTING FROM CIRCUMSTANCES BEYOND OUR REASONABLE CONTROL, INCLUDING SOPHISTICATED CYBER-ATTACKS, HACKING, OR SECURITY BREACHES.

You are responsible for maintaining the confidentiality of your account credentials. Notify us immediately if you suspect unauthorized access to your account.

10. Your Privacy Rights and Choices

Depending on your location and subject to applicable law, you may have certain rights regarding your Personal Data. However, these rights are not absolute and may be subject to limitations, exceptions, and conditions.

  • Deny requests where exceptions apply under applicable law

You may designate an authorized agent to make requests on your behalf. We may require proof of authorization and may need to verify your identity directly.

10.8 Non-Discrimination

We will not discriminate against you for exercising your privacy rights. However, we may:

  • Charge different prices or provide different quality of services if the difference is reasonably related to the value of your Personal Data
